2. Devices Subject to Section 524B

ENSection 524B of the FD&C Act and its requirements apply to “cyber devices.” Section 524B(c) of the FD&C Act defines a “cyber device” as a device that meets all of the following criteria

EN(1) includes software validated, installed, or authorized by the sponsor as a device or in a device;

EN(2) has the ability to connect to the internet; and
KR(2) 인터넷에 연결할 수 있는 기능을 가질 것,
EN(3) contains any such technological characteristics validated, installed, or authorized by the sponsor that could be vulnerable to cybersecurity threats.
KR(3) 스폰서에 의해 검증, 설치 또는 승인된 기술적 특성을 포함하며, 해당 특성이 사이버보안 위협에 취약할 수 있을 것.
사이버 장치에 대한 FDA의 해석
ENSFDA considers a “cyber device” to include devices that are or contain software, including software that is firmware or programmable logic.
KRFDA는 “사이버 장치”를 소프트웨어를 포함하거나 소프트웨어로 구성된 장치로 간주하며, 여기에는 펌웨어(firmware)나 프로그래머블 로직(programmable logic) 형태의 소프트웨어도 포함됩니다.
ENFDA also considers the “ability to connect to the internet” to include devices that are able to connect to the internet, whether intentionally or unintentionally, through any means (including at any point identified in the evaluation of the threat surface of the device and the environment of use).

ENIt is well-demonstrated that if a device has the ability to connect to the Internet, it is possible that it can be connected to the Internet, regardless of whether such connectivity was intended by the device sponsor.

  • Network, server, or Cloud Service Provider connections;

  • Radio-frequency communications (e.g., Wi-Fi, cellular, Bluetooth, Bluetooth Low Energy);
  • 무선 주파수 통신 (예: Wi-Fi, 셀룰러, 블루투스, 저전력 블루투스)
  • Magnetic inductive communications;59 and
  • 자기 유도 통신
  • Hardware connectors capable of connecting to the internet (e.g., USB, ethernet, serial port).60

Attact Surface (or Threat Surface)
  • Attack Surface (Threat Surface): The set of points on the boundary of a system, a system element, or an environment where an attacker can try to enter, cause an effect on, or extract data from, that system, system element, or environment.
  • 공격 표면 (위협 표면): 공격자가 시스템, 시스템 요소 또는 환경에 진입하거나, 영향을 미치거나, 데이터를 추출하려고 시도할 수 있는 해당 시스템 및 환경 경계상의 모든 지점의 집합.
  • This includes all avenues of ingress and egress to and from a system including common vulnerabilities and exposed ports and services.
